1. Agreement to these Terms These Terms of Service (“Terms”) govern your use of the GOM Games online store, website, and related services (collectively, the “Store”). By accessing the Store, creating an account, or placing an order, you agree to these Terms and to the policies incorporated into them, including our Return & Refund Policy and Privacy Policy. If you do not agree to these Terms, please do not use the Store. The Store is operated by GOM Games LLC, an Oregon limited liability company (“GOM Games,” “we,” “us,” or “our”). Eligibility You must be legally capable of entering into a purchase agreement in your jurisdiction or have the permission of a parent or legal guardian. By placing an order, you represent that the information you provide is accurate and that you are authorized to use the payment method submitted. 3. Products, pricing, and availability We make reasonable efforts to accurately display product information, including names, sets, editions, conditions, quantities, images, and pricing. However, errors may occasionally occur. GOM Games reserves the right to:
- Correct pricing, description, inventory, or listing errors.
- Update product information at any time.
- Limit quantities purchased by a customer or account.
- Refuse or cancel an order when reasonably necessary, including because of inventory errors, pricing errors, suspected fraud, payment problems, or other legitimate business reasons.
If we cancel an order after payment has been collected, the applicable payment will be refunded. All prices are shown in U.S. dollars (USD) unless otherwise stated. Applicable taxes and shipping charges are calculated or displayed during checkout. Inventory is limited and availability is not guaranteed until an order is successfully completed. 4. Trading card condition Trading card condition may involve some degree of judgment. We make reasonable efforts to accurately represent the condition of cards offered for sale. Minor manufacturing imperfections or variations that are reasonably consistent with the listed condition do not necessarily constitute a listing error. Card images may be representative rather than images of the exact card being purchased unless the listing specifically states otherwise. If you believe an item you received was materially different from its listing or condition description, contact [email protected] in accordance with our Return & Refund Policy. 5. Orders and payment Submitting an order constitutes an offer to purchase the items in that order. An automated order confirmation does not necessarily mean that we have accepted the order. We reserve the right to decline or cancel an order as permitted by these Terms and applicable law. Payments are processed by third-party payment providers. By submitting payment, you authorize the applicable payment provider to charge the total amount shown at checkout, including merchandise, taxes, shipping, and any other disclosed charges. GOM Games does not store complete credit or debit card numbers. 6. Shipping and delivery Available shipping services, prices, and estimated delivery times are displayed during checkout where applicable. Shipping and delivery estimates are estimates only and are not guaranteed. GOM Games is not responsible for delays caused by shipping carriers, severe weather, natural disasters, incorrect customer-provided addresses, or other circumstances outside our reasonable control. Customers are responsible for providing a complete and accurate shipping address. If an order is returned to us because an incorrect or incomplete address was provided, additional shipping charges may be required before the order is resent. Returns and refunds Returns, refunds, replacements, and order-error claims are governed by our Return & Refund Policy, which is incorporated into these Terms. Except as provided in that policy or required by applicable law, purchases from GOM Games are final sale. 8. Gift cards and store credit Gift cards and store credit issued by GOM Games may be redeemed for eligible purchases from GOM Games. Unless otherwise stated:
- Gift cards and store credit do not earn interest.
- Gift cards are not reloadable unless specifically indicated.
- Gift-card balances remain available for future eligible purchases until exhausted.
- If the gift-card balance does not cover the full purchase amount, the remaining balance must be paid using another accepted payment method.
- Gift cards and store credit are not redeemable for cash except where required by applicable law.
- Gift cards and store credit may not be returned for a refund except where required by law.
- Gift cards may not be resold or used for unauthorized commercial purposes.
- We may refuse, cancel, or void gift cards obtained through fraud, unauthorized transactions, chargebacks, or other unlawful activity.
Customers should treat gift-card codes like cash. GOM Games may be unable to replace a gift card that has been lost, shared, stolen, or redeemed without authorization. 9. Customer accounts You may have the option to create a customer account. You are responsible for:
- Maintaining the confidentiality of your login information.
- Providing accurate account information.
- Activity conducted through your account.
- Promptly notifying us if you believe your account has been accessed without authorization.
We may suspend or terminate accounts used in violation of these Terms, for fraudulent activity, or for conduct that threatens the security or operation of the Store. 10. Acceptable use You may not use the Store:
- For unlawful, fraudulent, or abusive purposes.
- To interfere with or disrupt the Store or its systems.
- To attempt unauthorized access to accounts, systems, or data.
- To introduce malicious software or code.
- To scrape, automate, or excessively access the Store in a manner that disrupts its operation.
- To impersonate another person or provide intentionally false information.
- To engage in payment fraud, chargeback abuse, or other fraudulent activity.
11. Intellectual property The GOM Games name, logo, branding, website content, original graphics, and other materials created by GOM Games are owned by GOM Games LLC or used with permission. Trading card names, game names, artwork, manufacturer logos, card images, and other third-party trademarks or copyrighted materials remain the property of their respective owners. The sale of third-party products does not imply sponsorship, endorsement, or affiliation unless expressly stated. 12. Third-party services The Store may rely on third-party services for payment processing, website operation, shipping, analytics, authentication, or other functionality. Your use of certain third-party services may also be subject to their terms and privacy policies. GOM Games is not responsible for third-party services to the extent permitted by applicable law. 13. Disclaimer of warranties To the fullest extent permitted by applicable law, the Store and its services are provided on an “as is” and “as available” basis. We do not guarantee that the Store will always be uninterrupted, error-free, or available. Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded. 14. Limitation of liability To the fullest extent permitted by applicable law, GOM Games LLC will not be liable for indirect, incidental, special, or consequential damages arising from use of the Store or the purchase of products. Where permitted by law, our total liability relating to an order will not exceed the amount paid to GOM Games for the order giving rise to the claim. These limitations do not apply where prohibited by law. 15. Fraud and chargebacks If you believe there is a legitimate problem with an order, please contact [email protected] so we have an opportunity to resolve the issue. Fraudulent chargebacks, false claims, payment disputes made in bad faith, or misuse of payment systems may result in order cancellation, account suspension, or refusal of future transactions. Nothing in this section limits a customer's lawful rights to dispute an unauthorized or otherwise validly disputable transaction. 16. Governing law These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Any legal proceeding relating to these Terms will be brought in a court of competent jurisdiction in Oregon, unless applicable law provides the customer with a different right or venue. 17. Severability If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect. 18. Changes to these Terms We may update these Terms periodically to reflect changes to our Store, business practices, or legal requirements. Updated Terms become effective when posted unless otherwise stated. Your continued use of the Store after updated Terms take effect constitutes acceptance of the revised Terms to the extent permitted by law. 19.
